Peak to Creek Properties Ltd.

1. Renter Requirements
The individual making the reservation (hereinafter referred to as the "Guest") must be the same person as the credit
cardholder. Any additional occupants shall be regarded as "Invitees" of the Guest. All communications, including but not
limited to reservation modifications, cancellations, and discussions regarding damages, shall solely be addressed with the
Guest.
2. Payment Procedure
60 Days Before Arrival: A non-refundable deposit equal to 25% of the total reservation amount is required.
45 Days Before Arrival: The remaining balance is due and payable. Failure to remit the balance by the due date may result
in cancellation of the reservation without a refund of the initial deposit.
3. Cancellation Policy
60+ Days Before Arrival: 100% of the deposit is refundable.
45-59 Days Before Arrival: 75% of the total reservation amount is refundable.
Less than 45 Days Before Arrival: No refund or credit will be issued.
Refunds shall not be granted for cancellations or disruptions due to circumstances beyond the control of Peak to Creek
Properties, including but not limited to weather conditions, road closures, power outages, natural disasters, pandemics, or
acts of terrorism.
4. Accidents/Damage Policy
A one-time Accidental Damage Protection fee will be applied to cover accidental damages during the Guest’s stay, as
follows:
- Studio/1 Bedroom: $20 (up to $500 coverage)
- 2 Bedroom: $30 (up to $750 coverage)
- 3 Bedroom: $45 (up to $1,000 coverage)
- 4 Bedroom: $60 (up to $1,250 coverage)
- 5 Bedroom: $90 (up to $1,500 coverage)
All accidental damages must be reported to Peak to Creek Properties within 24 hours of departure to be eligible for
coverage. Intentional damage, negligence, or misuse of the property is not covered, and the Guest shall be liable for the full
cost of repairs or replacements.
5. Damage Pre-Authorization
A pre-authorization hold will be placed on the Guest’s credit card one (1) day before arrival, based on property size:
- Studio/1 & 2 Bedroom: $500 CAD
- 3 Bedroom: $1,000 CAD
- 4 Bedroom: $1,500 CAD
- 5 Bedroom: $2,000 CAD
Peak to Creek Properties reserves the right to charge the full or partial pre-authorization amount for damages, excessive
cleaning, or other costs incurred due to negligence or intentional damage during the Guest's stay.
6. Arrival & Departure
Check-In: Standard check-in time is 4:00 PM. Early check-ins may be available upon request and are subject to availability
and additional fees.
Same-Day Bookings: Peak to Creek Properties reserves the right to adjust the check-in time up to 7:00 PM for same-day
bookings, depending on booking time and property readiness.
Check-Out: Check-out is at 10:00 AM. Late check-outs may be arranged upon request, subject to availability and additional
charges.
7. Minimum Age Requirement
The minimum age for making a reservation is 25 years, and the Guest must be present throughout the stay. Certain
properties may impose higher minimum age requirements, which will be clearly stated at the time of booking.
8. Occupancy Limit
The number of occupants must not exceed the specified maximum occupancy listed in the reservation. Parties or gatherings
involving non-registered guests are strictly prohibited and may result in immediate eviction and forfeiture of all payments.
9. Parking
One parking space is included unless otherwise specified. Additional parking is subject to availability and applicable fees.
Guests are responsible for returning any provided parking passes upon departure. Failure to do so will incur a $150 fine.
10. Good Neighbour Policy
Quiet hours are from 10:00 PM to 8:00 AM, in compliance with local regulations. Excessive noise or disturbances may result
in fines, eviction, and forfeiture of all payments.
11. Pets
Pets are permitted only in designated pet-friendly properties and are subject to a non-refundable pet fee:
- 1-3 Bedroom Properties: $75 + applicable taxes
- 4+ Bedroom Properties: $100 + applicable taxes
Unauthorized pets will incur a $500 fee and possible eviction.
12. Smoking
Smoking of any kind is strictly prohibited inside the property, on balconies, or in shared areas. Violation of this policy will
result in a $500 fine.
13. Indemnity & Limitation of Liability
Peak to Creek Properties acts solely as a rental agent and is not liable for personal injury, property loss, or damage incurred
during the Guest's stay. The Guest agrees to indemnify and hold harmless Peak to Creek Properties, its officers, agents,
employees, and property owners from any and all claims, damages, or losses, including legal fees, arising from the Guest's
use of the property or violations of these Terms & Conditions.
14. Right of Entry
Peak to Creek Properties reserves the right to enter the property in the event of an emergency or to conduct necessary
repairs. Reasonable notice will be provided unless immediate entry is required for safety reasons.
15. Security & Safety
The Guest is responsible for securing the property during their stay, including locking doors and windows. Use of candles,
fireworks, or other fire hazards is prohibited.
16. Check-Out Procedure
The property must be left in a generally clean condition, with all personal belongings removed and garbage properly
disposed of. Excessive cleaning may result in additional charges.
17. Waste Management
Proper disposal of garbage, recycling, and compost is mandatory. Failure to comply with local waste management
regulations may result in fines, which will be charged to the Guest.
18. Force Majeure
Peak to Creek Properties shall not be liable for any failure to perform its obligations hereunder due to events beyond its
reasonable control, including but not limited to natural disasters, acts of war, government actions, pandemics, or other
events deemed to be "force majeure." In such cases, Peak to Creek Properties may cancel or modify the reservation,
without liability.
19. Dispute Resolution
Any disputes arising from or relating to these Terms & Conditions or the rental agreement shall be governed by the laws of
the Province of British Columbia. In the event of a dispute, both parties agree to first attempt resolution through good-faith
negotiations. If a resolution cannot be reached, the dispute shall be submitted to binding arbitration in Vancouver, BC.
20. Privacy Policy
Please review our Privacy Policy for information on how we collect, use, and protect your personal information. By making a
booking, you consent to the collection and use of your information as described in the Privacy Policy.
21. Severability Clause
If any provision of these Terms & Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, the
remaining provisions shall remain in full force and effect.
